Amendment to the regulation on the detailed scope and form of the construction project

On December 10, an amendment to the regulation that many architects have been waiting for was announced in the Official Gazette. It will reduce unnecessary bureaucracy associated with the land development project.

The Decree of the Minister of Development and Technology dated November 23, 2021, amending the Decree on the detailed scope and form of the construction project, was published in the Law Gazette.

The previous paragraph in the Ordinance of the Minister of Development (Official Gazette, item 1609 of 2020) on the detailed scope and form of the construction project read as follows:

§ 15. 1. The drawing part of the project for the development of a plot or land shall be drawn up on an up-to-date map for design purposes or a copy thereof certified as a true copy by the designer.

The most recent regulation (OJ 2021, item 2280) deletes the words "certified as consistent with the original by the designer".

The current paragraph reads as follows:

§ 15. 1. The drawing part of the project for the development of a plot or land shall be prepared on a current map for design purposes or a copy thereof.

What does the regulation change?

Once in force, a copy of the drawing part of the plot or land development project will not need to be certified as a true copy by the designer. This design is to specify the location of the plot in relation to neighboring land, indicate its boundaries, and include all the most important information about the project.

Previously, the development project could be made on a copy of a current map for design purposes. Once the design was made on a scan or digital version of the map, a printout of the drawing was made, and then the designer certified that the printout was true to the original. The current procedure does not require certification of conformity for copies.

TheOrdinance of 10.12.2021 enters into force on the twenty-fifth of December this year after publication and is available in the Official Gazette.
